Conditions of Sale

  1. Definitions:
    1. Hereafter Eskimowear and Eskimowear Ltd are referred to as 'the Firm'.
    2. The entire contract is the document(s) that specify the terms and conditions and all other details.
    3. The individual, company, corporation or public authority shown as the invoicee is hereafter referred to as 'the Buyer'.
    4. The goods and products sold by the Firm are hereafter referred to as 'the Goods'.
    5. The parties to the Contract are the Seller of the Goods (the Firm) and the Buyer.
    6. The person(s), company, corporation or public authority accountable for delivery of the Goods to the delivery address, including the Firm where the Firm delivers, shall be hereafter referred to as 'the Carrier'.
    7. The person(s), company, corporation or public authority to which the Goods are delivered and whom is not the Buyer shall be hereafter referred to as 'the Recipient'.
    8. This Contract shall be governed by and interpreted in accordance with the laws and statutes of England and Wales.
  2. Risk and Title of Goods

    The risk in the Goods shall pass on to the Buyer immediately on delivery to the Buyer or Recipient. The property in the Goods shall remain that of the Firm until all monies due to the Firm as stipulated in Clause 5 have been paid by the Buyer to the Firm in full.

  3. Receipt

    The Buyer or the Recipient where applicable, shall receive and unload the Goods in the presence of the Carrier. In the event that the Goods are in an unsatisfactory condition or there is a shortage; the Buyer or Recipient must endorse the Carrier's documentation and separately notify the Firm in writing (either via post, email or fax) thereof within three days of delivery. In the event that this condition is not observed, no claim in respect of shortage or unsatisfactory condition of the Goods will be entertained. This condition does not affect the statutory rights of the Buyer.

  4. Pricing
    1. Where we charge separately for packing, carriage and insurance and other relevant charges, the appropriate rates are set out in our specified pricing structure shown elsewhere on this Website.
    2. The total price payable will be stipulated at the time when you place your order whether or not the order has been acknowledged. We are entitled to make adjustments to the price to take account of any increase in our suppliers' prices, or the imposition of any taxes or duties, or if due to an error or omission the price published for the goods is wrong whether or not the order has been acknowledged. We will inform you of the correct price and give you the opportunity to cancel the order. All prices are inclusive of VAT but exclusive of delivery charges which will be payable as indicated at the time the order is placed.
    3. From time to time the prices displayed on our website may be different if you are directed to it from a third party website. Purchases at these prices can only be made on our website and by arriving on it through a relevant third party website; these prices will not be available in-store or over the telephone.
    4. Prices, offers and products are subject to availability and may change before (but not after) we accept your order. If a product becomes unavailable we may offer you an alternative or suggest that you (re-)visit one of our stores.
    5. On occasion, the prices payable and promotions offered in respect of goods advertised on the website may differ from those prices and promotions offered at the same time in-store. We are under no obligation to honour any in-store price or promotion in the event that they differ from those on the website. Similarly, our store is under no obligation to honour any website price or promotion in the event that they differ from those in-store.
    6. Although we endeavour to ensure that all pricing information on the website is accurate, occasionally an error may occur and goods may be mispriced. If we discover a pricing error we will, at our discretion, either: contact you and ask you whether you wish to cancel your order or continue with the order at the correct price; or notify you that we have cancelled your order. We will not be obliged to supply goods at the incorrect price.
    7. Prices that are reduced for sales and promotions are only valid for the specified period.
  5. When the Contract Comes into Being

    The Contract shall come into being between the Buyer and Firm when the Buyer has placed an order, detailing his requirements and agreeing to be bound by these conditions, and the Firm has accepted the order.

  6. Returns
    1. If you wish to cancel your order:
      1. you can notify us by email to sales@eskimowear.co.uk before we have despatched the goods to you; or
      2. where goods have already been despatched to you, by informing us in writing within 7 daysby returning goods to us in accordance with clause 7.2 below.
    2. You can return goods you have ordered from us for any reason at any time within 7 days of receipt for a full refund or exchange. The costs of returning goods to us shall be borne by you.We suggest for your own protection you use 1st class registered post.
    3. Upon receipt of the goods we will give you a full refund of the amount paid excluding P & P or an exchange as required. Where an item is sold with delivery included in the price any refund due will be minus a charge for initial outward delivery. This will be equal to the amount paid by Eskimowear Ltd for delivery to you.
    4. The rights to return the goods to us as referred to in clause 7.3 will not apply in the following circumstances: - In the event that the product has been used; where the packaging has been damaged or tags removed; where the products have been made, personalised or customised specifically for you; any products that by their nature have a limited lifespan, such as flowers and fresh food. The provisions of this clause do not affect your statutory rights.
    5. Any item that is Pre-Ordered is classed as a bespoke order and as such is non-refundable. We will be obtaining the item(s) specially for you and in most cases these cannot be re-sold so we will be unable to accept returns.
    6. In the event of an item being returned to Eskimowear Ltd as the result of the carrier being unable to deliver we will contact you to arrange re-delivery. You will be liable for any re-delivery costs due. Should you decide you wish to cancel your order any refund issued will be less the original outward delivery charge. If the item(s) ordered qualified for free delivery any refund due will be minus a charge for initial outward delivery. This will be equal to the amount paid by Eskimowear Ltd for delivery to you .
    7. Any goods with manufacturing faults on arrival will be replaced or refunded. This does not affect your statutory rights.
  7. Delivery
    1. Delivery is charged as priced on each order. Your order will usually be sent on next day delivery. Once you have placed an order it will be dispatched the same day or the next day depending on the time the order was placed. If you wish to cancel your order after it has been dispatched, you will be charged for both delivery and collection cost.
    2. If you are unavailable when our delivery partner tries to deliver your order, they will usually try to deliver again the next working day or they will drop a card in to offer you a collection from a local collection point. If you should refuse delivery of goods, or are not available to accept the delivery on both delivery attempts, you will be required to cover any extra costs incurred.
    3. All quoted delivery prices are for most UK Mainland addresses. Northern Ireland (BT), Isle of Wight (PO30-37), Isle of Man (IM), Scottish Highlands and Orkney Isles (PA, ML, EH, KA, G, KY, PH, DD, AB, IV, KW), Outer Hebrides and the Shetland Isles (HS, ZE) will incur additional charges and may also experience delivery delays; morning, Saturday and "next working day" deliveries are optional and will also incur additional charges.
    4. We will only deliver goods to the address on the order.
    5. Where, for administrative convenience, the Buyer or his agent is requested by the Firm to sign a delivery note before the Goods are handed over, the Buyer or his agent agrees to examine the Goods at the time of the physical hand-over and the effect of such signature in respect of receipt of the Goods will not become operative until immediately after the physical hand-over.
  8. Product Availability

    All Goods, including promotional items and Goods 'on offer' are subject to availability and may be withdrawn from sale at any time; including after an order is placed. In the event that the Goods become unavailable after an order is placed, the Firm will make every attempt to 'back order' and inform the Buyer of the situation. The Buyer will be given the option to cancel the order in this occurrence.

  9. Order Processing

    Your order is sent directly to our secure till in our shop for processing. Once we have received your order and payment, our staff will pick, pack and dispatch the item. We will aim to do this the same day for all orders in to our shop Mon-Sat (excl Bank Holidays).

  10. Order Tracking

    You can track the progress of your order at any time by logging into My Account from the Home page on this website.

  11. Privacy Policy
    1. Eskimowear Ltd is committed to protecting your privacy. We will only use information given at the time of ordering or when making an enquiry by whatever means is collected lawfully and in accordance with the Data Protection Act 1998.
    2. We do not pass your personal information on to third parties other than the courier service we use to deliver your goods to you.
    3. All transactions that you initiate with Eskimowear Ltd on this web site are confidential. Your name will not be added to any third party mailing lists.
    4. Under the terms of the Data Protection Act 1998, we have a duty to protect any information we collect from you. It will not be disclosed to any other organisation unless you give explicit permission, or there is a legal obligation to do so. We collect information about you for two main reasons: a)To process your online order. b)To provide you with the most efficient possible service.
    5. The information collected will be used to personally keep in touch and let you know of any offers, sales or promotions that Eskimowear Ltd are carrying out (if you have selected to receive these emails/newsletters).
    6. You have a right to request a copy of any personal data held by Eskimowear Ltd at any time, in order to check its accuracy. If you wish to do this, please write (explaining that your interest is in personal data maintained by Eskimowear Ltd) to: Eskimowear Ltd, 12-16 Hockley Rd, Rayleigh, SS6 8EB.
    7. This privacy policy will change from time to time as we develop the range of services on the website. When this privacy policy changes, we will place an updated version on this page. Regularly reviewing this page ensures that you are always aware of what information we collect, how we use it and under what circumstances, if any, we will share it with other parties. You should always check the privacy policy before using this site, even if you have visited it in the past. This ensures that you will be aware of any changes. Changes to our privacy policy do not affect information we already hold about you. This statement was last updated on 1st September 2010.

    Any failure by the Firm to enforce any or all of these conditions shall not be construed as a waiver of any of the Firm's rights hereunder.

  14. Terms of Contract

    These conditions have effect in substitution for and to the exclusion of, any Condition put forward by the Buyer , shall be governed by the laws of England and require that you agree to submit to the non-exclusive jurisdiction of the English courts. We are required by law to inform you that sales can be concluded in English only and that no public filing requirements apply.
